A Brief Summary
About the
biography of the religious authoritative Source , His Eminence , Grand Ayatollah
, Al - Sheikh , Muhammad Ishaq Al - Fayadh ( May God lengthen his
Patronage ) : -
Introduction : -
It is too
difficult , in fact , rather impossible for a writer of an essay about one
(flag) of Jurisprudence (flags) ,who is a skilful teacher , and a researcher of
great position among the high level scholars of the sect , collecting all these
information a bout the aspects of his life and his privacies in one brief
summary .But depending on the base which says : ( What is possible must not be
ignored because of the impossible ) , I make my attempt in mentioning one
biography of one of those great genius and honorable prominent , with some
privacies about his outstanding personality .That one is the great scholar and
investigating researcher His Eminence Ayatollah the pilgrim Sheikh
Muhammad Ishaq Al - Fayadh ( God
lengthen his patronage ) , Making use
,through this attempt, of what I have read
,heard and touched closely from him . I do this at the time when
something excites pain and grief in me for what
do those people suffer from wrong , tyranny , and the ignorance - of
most of people around them - of the high rank they occupy , but, at the same
time, this invokes us to admire and highly respect them for what(those
pious)has introduced and do introduce to the Divine Religion in general and to
Islam in particular , nevertheless what
troubles do they face and what difficulties do they bear , doing all this with
humbleness of mood ,nice ethics ,integrity and piety , away from the lights and
figures of this terminated life .
The Religion Scholars` Role : -
From the
first time the Sheikh of the sect put the first brick of the Scientific
Religious Foundation (I . e . Al - Hawza ) in Sacred Najaf ,
running away from the tyranny of the cousins ( Al - Abbasyeen ) when
they were killing Al - Mualeen {I . e . the followers of Ahlul Bayte
( peace be upon them ) } , attacking Al- Sheikh's house and burning his
library which contained many valuable books ,all of that made him compelled to
leave Baghdad and restore to the neighborhood of the shrine of(the Imam of
Imams) and the Executor of the Messenger of Allah ( peace be upon him and his
family )( the prince of the faithful and the Master of the monotheists) Ali-Ibin-Abytalib
(peace be upon him ), to continue ,at that place, serving religion and teaching
the nation from the flood of sciences of Aall Al - Rasool (I .e . The
Messenger's family ) ( peace be upon him
and his family ) , and to spread the Fiqih ( I . e . Jurisprudence ) of Ahlul
Bayet ( his family ) ( peace be upon them ) through showing the lawful
rules and bringing people up on the way and ethics of lofty Islam .
Then ,
afterwards , the scholars of Shiites
continued, generation after generation ,to perform that sacred duty , and
everyone of them has his own privacies and what makes him outstanding among his
colleagues which is his production through his giving and conduct , although
they all share in the high end that they seek ,( I . e . serving Religion and
the true Doctrine), that end which through it they aim to spread knowledge and happiness all over the world,
in this Earthly life and in the Hereafter .
Through
going on along this path , most of them endured the wrong of tyrant rulers and
their followers , therefore, each one of those scholars has his private story
that relates to us his and his family's wrong because of killing , being put in
jail , and at least restraining their lives and making them homeless . The same
thing happened, in the past ,to their Imams (the Imams of the right way) (peace
be upon them all ) who represent their examples in life. God had blessed those
men during the consecutive times and successive eras with different great gifts
, with the abundance of His mercy , and patronized them with the eye of His
divine providence . He gave them His blessings and favor , to let them be the
guardians of his Religion , to keep up the legislation of the last of His
prophets , to let them manifest what is lawful form what is not, to His slaves
, and to let them guide people to His right way ( in the time of the absence of
His patron upon people and the Imam of contemporary time, the Hujja :
Muhammad Ibnul - Hassan Al - Askary ( God hasten his honorable happy ending ,
and make us among those who support him ,who be his faithful helpers and
martyrs in front of him ).
Also , if
one of those (flags) be specialized in one important side that he had been
famous with , through penetrating deeply into that field and being prominent in
it more than other scholars ,such as when someone endows himself to the mission
of defending Islam with its fortress and observing the atheists and tendentious
attacks, in order to drive them back , also pushing away the falseness of the
malicious against Islam and Ahlul Bayet doctrine ( peace be upon them )
then showing the truthfulness of following them as well as the gravity and
powerfulness of their believes . Therefore , there were some of them who had to
do their best through being specialized in Iftaa ( i.e. Answering
religious inquiries ) , in judicature , in showing what is hallal ( i.e.
lawful ) and what is haram ( ( I
. e. unlawful ) in Islam , and in writing volumes of books . Some of them did
another job, which is taking care of the moral side to reform people's conduct
, to set them right , to look after the nation's affairs , and to help the
poor(I . e . people in need) , whenever others were concentrating on teaching
and bringing up generations , and so on . But for a time, there were some of
those ( flags ) to be prominent and successful in serving and in giving, in
more than one side , thus it is collected for him ( I. e . such characteristics
like the scientific excellence in Fiqih ( I . e . Jurisprudence ) , in Usool
( I . e . the shared rules that precede juiristic researches),together with his
being on top of Al-Marjeeia Al-Ulya(I . e . the highest religious
authoritative source ) , also his penetrating deeply and being specialized in
more than one art , all of that didn’t stop him from (penetrating) other
sciences , from writing , or teaching , in addition to what he produces like
new invented theories in different fields in which he ( dives ) deeply ,
together with his interest in social subjects and taking care of the nation's
affairs and welfare .
Al - Saiid Al - Khuee : -
One of
those great people who is the master of jurists , mujtahid scholars and
teachers of the contemporary generation of Imami scholars and jurists , the
departed guide grand Ayatollah Al-Saiid Abul Qassim Al- Musawi Al- Khuee
( 1317 A.D. - 415 A.H. ) ( May God be pleased with him ) . He was an
outstanding personality and a skillful teacher of great fame . He was like a
bird flying in (the sky of Usool Al- Fiqih science) and at the
same time he proved to be a skillful researcher
that all scholars admit his favors upon them, and all investigators show
their indebtedness towards him , until he had been the first teacher of that
science . Thus, he had been entitled the ( Flag ) of Usool and the
Renewer, because of the large number of inventions he introduced in that art
,specially in his book ( Ajwad Al- Taqreerat ) ( I . e . the statements
of his teacher Ayatollah Al- Shaykh M. Hussain Al- Naeeni ( his soul be
sanctified ) researches) , and in the several statements of his researches
which were written down by Ayatollah Al- Sheikh M. Ishaq Al-
Fayadh in his book ( Al- Muhadharat )which consists of ten volumes ( five of them are printed ) .
His skill
(his soul be sanctified ) in Jurisprudence is not less important or less
excellent than his observation & deep investigation in Usool , since
that he was the teacher of Fiqih ( I . e . Jurisprudence ) for more
than half of a century , and Jurists ,
that follow , took from him, later on .
His
theories in Fiqih were written down in statements by the best of his
students in tens of titles and volumes of books which are considered these days
the best references for researchers , scholars , or students of the scientific
religious foundations ( I . e . Hawzas ) , and over these theories run
the ( millstone ) of researches and lessons in these scientific hawzas .
One of his
privacies ( God spare his soul ) that he dedicated his time to : - ( The Men of
Hadeeth Science ), that he considered the important means in observing
and differentiating the truthful hadeeth ( I . e . tale ) from the false
one , the trustful from Al-Dhae`ef ( I . e . the non - trustful ) ,
because in order to judge a certain narrator of hadeeth whether truthful
or not, then to make sure that the tale is really issued by the Infallible
himself ( peace be upon him )or not ,in order to look for the indications , and
to draw( out ) the legitimate rule finally , therefore, he established this
science and put down it's special bases , together with the biographies of
15706 narrator and teller of hadeeth in his valuable book ( Mujaam
Rejaal Al-Hadeeth Wa Tafseel Tabakat Al-Ruwat ) ( I . e . The
Lexicon of Al-Hadeeth Men and the details of narrators categories ) ,
which is collected in 24 volumes .
When he (
his soul be sanctified ) dived into his researches in { Qura`an
Explanation Science } & other Qura`an Sciences , his style was the
style of a specialized skilful expert in this field , and his valuable product
( Al-Bayan Fi Tafseer Al- Qura`an ) was the best witness on his ability
in Tafseer ( I . e Explanation ) also on his penetrating deeply in what
is associated with Quraan Sciences .
Al -
Saiid Al - Khuee ( his soul be sanctified ) was not satisfied with the
treatment of Al - Fiqih , Usool Al - Fiqih , Explanation
& men of Hadeeth sciences , but he was also versed in { Usool Al
- Deen } ( I . e the origins of Religion ) and in { Creeds } , so he was
treating the subjects that were associated with Monotheism ,Devine Justice ,
Prophecy, Imamate & Resurrection ,in
the same degree of depth and gravity which were his other researches described
with , all of this did not bend him from giving himself the chance to dedicate
some of his time to writing and supplying the Islamic Library with his most
valuable books .
He , in
fact , was not known in composing verse , except on some special occasions ,sometimes
in Arabic , in Persian or in Turkish, in other times , but he ( God be pleased
with him ) refused to finish his life but with goodness, by composing a poem
concise in pronunciation , but great in meaning, also in monotheism , Justice ,
and Imamate , approaching to 156 verses in addition to 7 verses in History ,
therefore, the total number is 163 verses ,and that was during the last
few years of his honorable life .
All of that
was in addition to the bearing of the responsibility of Al-Marjeeia's
( I . e. the Authoritative Source's ) affairs and the patronage of the nation's
advantages .He was unique on top of the leadership of Hawza for a
quarter of a century in a very hard circumstance of distress and compulsion ,
and the Religious Marjeeia ( I . e the Authoritative Source) has never
been exposed, during it's history and the history of it's scientific Hawza
( I . e . the Religious Scientific Foundation for Religious studies), since
it's transmition from Baghdad to Honorable Najaf, to such hard and pressing circumstances that pressed from the
inside and the outside at the same time . Therefore, Al- Saiid Al-
Khuee's mission was ,first, to take care of the role and independence of
Scientific Hawza , and then to observe its scientific, juristic & social activities , in order to let the historical
role of Najaf in patronizing Al - Hawza with its religious institutions
, also to take care of the sect interests .
Al - Saiid
Al - Khuee's Students : -
Because of
his ( his soul be sanctified ) prominence in his excellent scientific method,
special style in research and teaching , he collected around him , along the
period of his teaching , which surpassed 70 years , a great number of religious
scientific studies students and brilliant teachers who belong to different
international countries .Thus, there were students from Syria , Lebanon , Ihsaa
, Qateef , Bahrain , Kuwait , Iran , Pakistan , India , Afghanistan , the
counties of the East of Asia , and Africa , in addition to the Iraqi students .
It is difficult to count that big number of students , to specify them , or to
show their scientific position and role in the Islamic Yard in general .
Thousands
of Shiite scholars did study under him
,those who are ,in fact, spread over the religious scientific foundations in
different parts of the world . Therefore , you would never find , an imam or a
person who is in charge of, or responsible for these scientific centers , who
did not take from Al - Saiid Al - Khuee, from one of his students or
their students , and out of them came hundreds of Mujtahids who are
today the teachers of Religious Hawza,who represent its pillars , who
run around them the leadership and the Religious Authoritative Source , or who
have been on top of it , after his death ( God be pleased with him ) . So by
the way ,we mention so of them : -

Muhammad Al - Rawhani ( his soul be sanctified ) - Iran , Ayatollah the
Martyr Al - Sheikh Mirza Ali Al - Gharawi - Iraq , Ayatollah
The Martyr Al - Sheikh Murtaza Al - Barujardi - Iraq , Ayatollah
( the departed ) Al - Saiid Muhyee Al - Deen Al - Ghuraifi - Bahrain , Ayatollah
The Martyr Al - Saiid Abdul Sahib Al - Hakeem - Iraq .
And one of
them was Ayatollah the martyr Al - Saiid Muhammad Bakir Al -
Sadir , the well known scholar , investigator & researcher , who says about
his teacher Al - Saiid Al - Khuee : - (( It is this teacher who I opened
my eyes to the light of learning in his Hawza , and tasted knowledge at
his hands , thus ,he is the greatest bliss ,after the boon of faith, that God
did grant man ,in the field of learning and knowledge ,therefore ,if I had,
really , gain some of that grace(I.e. knowledge),the favor of that is dew to
him , since I represent one fruit of those of his existence and honorable
abundance , and I am , in fact ,one of his spiritual sons )) .
Also one of
them was: His Eminence Grand Ayatollah Al - Saiid Ali Al -
Husaini Al - Sistany ( May his patronage last long ) who has been the chief of
the Scientific Religious Hawza in Honorable Najaf ,after the departure
of his teacher , and he is now considered
the highest authoritative source of the sect in the world. He says about his teacher : (( He { his soul
be sanctified} did spent an age which was full of his achievements and great
deeds that guaranteed the registration of his name in the book of the immortals
, and made him one of the prominent tops of our distinguished scholars who
still their names are repeated on tongues, generation after generation . It is
true that the Scientific Hawza and especially the sacred Hawza in
Honorable Najaf ,still remembers, in serious proud and elevated glory, his big
services and great efforts which were represented by his valuable scientific
heritage , and by the very long years that he spent in bringing up a generation
of scholars and praiseworthy men who drank from his abundant knowledge and who
are brought up in his honorable presence )) .
Also ,one
of those great genius , was the big savant and great investigator and
researcher , His Eminence Ayatollah the pilgrim Al - Sheikh
Muhammad Ishaq Al - Fayadh ( May his patronage last long ) whom we are about to
show his biography (I .e. chapters of his honorable life) , his traces ,
achievements , favors and great services for this blessed nation .
His Birth and Growth : -
Muhammad Ish`aq
is borne (in 1930 A.D.) in a village called ( Soba ) which is one of the
villages of ( Ghazni ) governorate in the middle of Afghanistan which lays at
the south of capital ( Cabul ) , and he is the second son to his father
Muhammad Ridha , after his elder brother Muhammad Ayoob . His father ( God
spare his soul ) who died in 1989 A.D. , was a simple peasant worked with some
of those rich people in the village , who were owners of lands , in order to
get a living to his family from the labor of his hand , but he was rich with
faith and with what he gave abundantly to his family (I .e . his passions and
emotions mixed up with the love of the Messenger and His chaste family ( S.W. )
.
And that
simple faithful peasant saw in his son Muhammad Ish`aq signals of superiority
and intelligence that made him compelled to give him special care and deep
patronage , as if he was reading in the features of his son , from the first
moment of his birth , what will this new born child be in future and what scientific rank , excellence , God fearing ,
and piety he will get , which make him qualified to do a prominent role in
serving his religion and faithful people .
The Beginning of His Learning : -
His father
was sending him, every day , to the
office of the village Sheikh - because there were no systematic schools
in the village at that time - in order to let him learn the principles of
reading and writing , also to learn reading Qura`an . When he was five
years old , during winter time , the generous father carried his little son
over his back covering him with enough covers to protect him from the stinging
cold, across rough streets , and heavy ice , in order to convey him to Al - Sheikh
office in the morning ,then to bring him back home in the afternoon . Thus,
that noble son can be fed from the fountains of science , knowledge , and
ethics .Also , in order to let him enjoy sympathy and compassion , so as to
grow on faith and love of Ahlul Bayte ( the prophet and his
family ) ( peace be upon them ) . Then , he decided to complete his studying in
religious Hawza , because it was the will of his father ( God spare his
soul ) , therefore, he learned from the village Sheikh the early
beginnings of science, and reading
Qura`an ,afterwards , he studied the book which is called ( Jamee` Al -
Mukaddimatt ) ( I . e . The Collector of Introductions ) and it is a book
that consists of more than ten books which are concise in Grammar , Morphology
, Logic , and Ethics for different authors , that have to be studied by
students of religious sciences as an introduction to the studying of the text
books that follow . Therefore , these concise books were called ( Jamee` Al
- Mukaddimatt ) .
The religious School : -
That hard
working student transmitted from Al - Sheikh`s office to the
village ( which is called : Hootqall ) and
lies in the neighborhood ,when he was fifteen years old , in order to
join the classes of the religious school which were established by Al - Sheikh
Kurban Ali Wah`idi ( God spare his soul ) who was one of the graduates of Honorable Najaf School in Iraq .
He finished
, at that school , studying the book ( Jamee` Al - Mukaddimatt ) and ( Al
- Bahjah Al - Mardhiya fi Sharh Al - Alfiaa ) which is well know in
the studying surroundings as ( Al - Sayooti Book ) due to its writer Jalal Al -
Deen Al - Sayooti who died in 911 A.H.
That book deals with Grammar and the rules of Arabic language . He
finished studying it in four years, under teachers ,such as Al - Shaykh
Mulla Ismaeel and Mulla Haidar Ali ( God spare their souls ) .
The system
of school , at that time , guarantees to a student a place for residing and
spending nights , in one of its small rooms , and the student must guarantee
his own costs of clothes and food which usually consists of wheat that is
brought from their houses to be kneaded and baked by some of the village women,
for nothing .
The Death of his Mother and
Transmission to Mashhad : -
At that
time, Muhammad Ishaq, lost his mother ( God spare her soul ) , that she passed
away because of a decease she was afflicted with . Therefore , he felt deep sorry for losing her and the lost was
too much painful for him , since he lost , by losing her , the affection and
compassion of motherhood . But, despite the hardness of the calamity , he was
not bowed from continuing his learning , on the contrary it increased his
insistence on that way to an extent that he decided to move from the village
school to the city of sacred Mashhad in Iran , and that was his first step
towards the aim which was going on in his mind , which he was working for with
strong enthusiasm , and wishing to achieve .That aim was represented by moving
to the old religious scientific Hawza of Honorable Najaf in Iraq .
At the City of Imam Ridha ( peace be
upon him ) : -
Shaykh
Muhammad Ish`aq settled , for one year , at the school of (( Hajj Hassan )) which lies in the region of (( Bala
Khayaban )) which had been involved by the project of extending the sacred
place of Imam Ridhah later on ,
therefore , that school collapsed and situated within the big yard of the Holy
place in present time . He studied, during that year, the book ( Hashia
( I . e . comment ) of Mulla Abdulla ) which is the comment on the book
( Tahtheeb ( I . e . Refinement )
of Mantiq ( I . e . logic )) for the Mulla ( I . e . Master ) Abdulla Ibn Shihab Al -
Deen Al - Hussaini ( died in 981 A.H. ) , also an amount from the book ( Al
- Mutawal ) for Saad Al - Deen Al - Taftazanee , in addition to that, he
studied Rhetoric under the supervision of the well known teacher (( Sheikh
Muhammad Hussain AL-Naishaboori )) ( God spare his soul )(who is known
as Al-Adeep(I .e . The Author)Al-Naishaboori), and there , the student Sheikh
noticed the difference in the kind of scientific benefit of the teacher and in
the teaching system ,since that the Naishaboori teacher asks for a fee for
teaching students even if it was symbolic , and that was in order to guarantee
a simple living , that is one thing , and to make sure that his students are
serious in their work to get knowledge , and they did not come just to get
formal presence in his teaching assembly . And it was His Eminence ( The soul
spared ) Ayatollah Al- Saiid
Yooniss Al - Ardabili, the big scholar, who was well known in the city
of Mashhad , who undertook the responsibility of getting the students bread ,
the same as the grand scholar ( The soul spared ) Al - Sheikh Ahmad Al -
Kifae`e , the son of Ayatollah Al - Sheikh Al - Akhond , who was in
charge of and responsible for the religious schools in Sacred Mashhad , he was
giving students monthly salary of about 40 rails ( nearly half a dollar, at
that time ) and by this simple amount of money the student guarantees his
simple daily life at its lower requests .
His Aim is to Reach Honorable Najaf
: -
These
difficulties and more , which were facing him , did not mean to the hardworking
persistent student anything but more insistence in studying and in achieving
his aim of reaching the religious scientific hawza of Honorable Najaf in
Iraq .
He was in
continuous questioning about the way of traveling to Najaf , because it was
impressed permanently in his mind - since he was young - the importance of
Najaf with its privacies , and this was due to what he heard about the
superiority of Najaf , as a city and a hawza, and that was the result of
what was going on in the students` speeches and their teachers` , especially
the scholars who were graduates of Najaf, who settled down at their homelands
after they finished their studying at Najaf. Among those scholars was the
founder of the religious school in which our sheikh studied, at the
village ( Hoot Kall ) ,and among them were those who still continue their
studying in Najaf and, meanwhile, were making repeated visits to their families
, thus, they convey , in their assemblies & lectures , the privacies of the
hawzas they visited and settled down at for a period of time , then they
would,certainly, mention the superiority of Najaf over other hawzas . Al
- Sheikh Al - Fayadh , in this regard , says : (( The first moment I heard
the name of Najaf and the rank of the scientific hawza there , was by
the Sheikh of our village , and then at the religious school , and each
time we heard a conversation about Najaf , we would hear,at the same time,
something about the prominent teacher in it , who was,undoubtedly, Al -
Saiid Al - Khuee , and that was by means of some of his righteous students
, as Al- Sheikh Aziz Allah Al - Kabuli , Al - Saiid Hamad
Hassan Al - Raees and Al- Sheikh Muhammad Ali Al
- Mudarriss ( God spare their souls all )) .
Honorable Najaf : -
Najaf is
the place where Man knew the first civilization and the first worship . In it,
the prophets: Adam , Noah , Hood , and Salih, were buried , and in it was the
house of the ( intimate ) Abraham ( peace be upon him ) .
Najaf is,
in fact, the extension of Heera and Koofa, which had been taken by Imam Ali (
peace be upon him ) as the capital of the Islamic caliphate , also it is the place where he
ordered to be buried in . And his grave became , afterwards, ( a torch of light
) from which life did arise, thus his lovers founded on that dry piece of land
a unique city , which is constructed and polished during time ,and day after
day . Since that date up to present day , Najaf went through different stages
and various circumstances , intensity ,
and weakness , the movement of immigration towards it some times ,and the stopping of that movement on other times ,
the activity and prosperity of scientific hawza sometimes and the
inactivity of it on other times , therefore , the glamour of this city fails
and its glitter fades one time , and then it returns to its normal case at
another , rather it would be in increased activity , movement , and giving,
more than the past, each time crisis be stressed upon it , that is because it
is the city of science , wisdom , grace , and it is a studying institute for
the whole Islamic Nation . That city did graduate tens of thousands of scholars
, and in it did settle down thinkers and great scholars who were versed in
Islamic sciences in general .
The Religious Scientific Hawza :
-
The Sheikh of sect : Al - Toosi , is
considered the first founder of Al - Najaf University and the builder of its
lofty ( tower ) which is represented by the religious scientific hawza ,
since his immigration to it from Baghdad ( in 448 A.H. )and his settling there,
until his death(in 460 A.H.) , and his burial in it , that city then faced the
flocking of students of religious sciences from all Arabian and Islamic
countries , and the little city opened its doors , and hugged to her chest, in
addition to her sons from the peoples of the world , sons whom she loved and be
loved by , therefore , she gave them her care , granted them the tongue of Holy
Qura`an , honored them with faith and made them rich with the wealth of the
sciences of the Imams of Aalu Bayte Al - Rasool ( I . e . the
family of the prophet ) ( S.W. ) . The
scientific movement then started to be active until that honorable city became
the supplier of the Islamic world , everyday , with its shiny new product ,
since its described as the city of science and Knowledge, which hugged the
sciences of this true Religion with its big ideological heritage, on the way of
the blessed leading Imams of Aal Al - Rasool ( I . e . the family of the
prophet ) ( S.W. ) .
Poverty was
painful in Najaf, at that time , therefore , most scholars with their families did not find ,
some times , even a loaf of bread , while they might had spent a day or two
without any food . Therefore, we may find that several of them passed away because
they were inflicted with bad nutrition or because they were unable to guarantee
the costs of medical treatment, until it be too late , or they be compelled to
leave their studying and return back home . But at the beginning of the
thirteenth century of the Hegira , the teachers and authoritative sources who
were supervisors of hawza , started to increase their care upon their
students towards more methodical ness
and precision to make the student more giving and enthusiastic towards gaining
knowledge , and not busy with how to gain his living or residence , therefore ,
they started to give students monthly salaries and established for them
buildings for residence . Therefore , students became more dominant upon time,
concerning studying and researching ,
despite the other difficulties do they face .
Al - Marjeeia ( I . e . The Authoritative Source
Position ) : -
Among the
ideological measures of Najaf , and along
its history ,there was the way of choosing a religious authoritative
source among its biggest scholars, in complete independence , and there is,
always , an intimate relationship between nation and the authoritative source ,
since he(I .e .the one who takes the responsibility of this position)
represents holiness, glorification , and the highest rank of knowledge in Fiqih
( I . e . jurisprudence ) , and Usool Al - Deen ( I . e. The Origins of
Religion ) , also he is the representative of the Absent Imam ( peace be upon
him ) , since it is stated in the orders of the infallible Imams ( peace be
upon him ) that people must turn to , and consult them ( I . e . The
Authoritative Sources ) , therefore , people turn to him ( I . e . The
Authoritative Source ) in learning the
legitimate rules and in what is related to their life affairs , also they give
him their loyalty, which is the result of their religious and dogmatic origins
in addition to what Al - Marjee ( I . e . The Authoritative Source
),himself, be adorned with of characteristics (such as: Piety , God fearing ,
Good ethics &Nice humble conduct ) , which qualify him to do the mission of
serving religion and faithful people . And Al- Marjee depends , usually
, on Holy Qura`an and the honorable Sunna of prophet
Muhammad(S.W.) ( I . e . the prophetic tradition ) , in the deduction of the
legitimate rules in order to guide people, in their lives and common affairs,to
the right way , and they turn to him ( I . e . Al- Marjee ) in all
things arise to them that are new , and on him lies the responsibility of
abiding to the principles and origins that represent the essence of Islam , and
be in touch with them concerning all that renews in their lives with their
different fields, by means of Al - Ijtihad process ( I . e . the process of
deduction of the legitimate rules ) .
Al - Marjeeia is a position which is represented by
the scholar who proved to be: loyal to the Islamic principles, strong in his
attitude, and do never conclude a truce with anyone or submit to him, whatever
temptations or threats might be. He defends the muslim and his inviolability by
the Islamic knowledge, logic , and ideology.He works to spread the spirit of
brotherhood, love , and equality among all muslims , with no attention to
social ranks or wealth concerning rghits and duties.
Al - Najaf and Its High Scientific
Rank : -
Al-Sheikh
M. Ridha Al - Ja`afari ( who is one of the prominent scholars , that have been
graduated from Najaf ) says : ((
Honorable Najaf differs from any spot all over the Shiite World , that
any Shiite is attracted to it and wishes to live in it , since that the shrine
of the Prince of the faithful(I .e .Imam Ali Ibn Abi Talib)(peace be upon him)
is situated there , and because of its scientific capital , despite the
difficulties of life which are due to several reasons . This characteristic is
not owned by any other Shiite land , other than Honorable Najaf , since
it is the attraction of the Shiites` hearts , and this means that Najaf
can live despite all kinds of hardship , distress , difficulty , sensitivities
and other things . And if the Shiites loose Najaf ( God forbid ) they
will never find any other spot to be a shelter to the Shiite ideology , so as
to hug the one who lives in it in a way that
a Shiite will never allow himself to leave her away to any other
place if there is more (( bread ))( at that 0ther place) , or more richness of
food . And the one who is attracted to it will never be allowed by himself to
leave it whatever the reason might be ,
and the scientific hawza is,in fact, a powerful factor which unites its
scattered pieces , which bring them all together whatever hard the political ,
natural , or social conditions might be .
Najaf is
founded Shiitic .It is resided by the followers of the Prince of the
faithful ( peace be upon him ) willing to be neighbours of that great bed , and
it is done , from the first moment of its establishment till present time , the
source of making Shiite people , and the hands of the consequent
policies could never intervene and make Najaf to fail being the authoritative
source of all of the Islamic world , or to make immigration toward it stop .
And those neighbours of the Prince of the faithful ( peace be upon him ) did
bear many distresses because of the thirst of some of the nomads to invade it ,
which reached to an extent , sometimes , that was impossible to bear . That was
the case , until they became secure after a time , the city quenched its thirst
, and Najaf became the capital of teaching Ja`afari Jurisprudence and all other
religion sciences . All of that happened the day when Al - Sheikh
of the sect M. Ibn Al - Hassan Al - Tussi did shift his scientific hawza
from Baghdad to Najaf ( at 448 A.H. ) , and it happened that teaching shifted
to Hilla and then to Kerbala , but it returned back to Najaf later on , and
dropped its packsaddle in it . )) .
And Al -
Sheikh M . Jawad Magnia , the well known Islamic writer and researcher ,
says , in describing Najaf the last century , that it is a city which includes
: (( people from Iran , Afghanistan , Russia , India , Tibit , Bahrain , Hijaz
, Syria , Lebanon , and Iraq , their population approaches eighty thousand
person , and despite the differences among these elements , Najaf has a very
special character that collects its people , mostly , and makes them
distinguished from others , which is the mark of religion in its different
branches and rituals . In the middle of the city lies the honorable shrine of
Imam Ali which is surrounded by markets and quarters from all directions , and
in each quarter there is a religious school , and several mosques , and for
each mosque there is an imam for the congregational prayer , and one ring of
the studying rings , and in Najaf there is no cinemas , and no places for
licentiousness , singing or unlawful amusement , and no shops for selling wine
, and wherever you go , you find studying rings , preaching , guidance , condolence assemblies , prayers: single and
in congregation , reciting Qura`an , praying , mentionings of Allah(to be
lofty) , and confidential talk , specially in the ten days of Muharram , in
Ramadhan( I.e. the month of fasting) , and in the visits ( of holy shrines )
days , since Najaf is a religious city in its schools , mosques , assemblies ,
clubs , and in most of its habits . Its emblem is simplicity and humbleness ,
no difference could be found - mostly - in it between the rich and the poor
concerning their clothes or residence , on the contrary , we may find many
owners of certain properties have left what they own for others and devoted
themselves only for worshiping , therefore, the number of ascetics ,
worshippers , and Sufis ( I . e . mystics ) , and many people immigrated to it
from far extremes of countries for the sake of that aim , turning away from
this present life with its pleasures.Also,it is obligatory that everyone lives
in Najaf or enters Najaf must submit willingly or obliged to religion and its
rituals , because of the surrounding environment and traditions , and no one, whoever could he be,
can break these inherited conditions )) .
The Influences of Najaf on its
Comers : -
Some of the
Influences of the religious factors that are mentioned before , the scholars` asceticism
, the educational and social habits together with the general rank of Najaf ,
that it gave birth to leading personalities
whose speeches and deeds were dedicated and brought forth for the sake
of God alone , so if they utter a word you find in it truth and guidance , and
if they keep silent , you find in their silence ideology , obedience to God ,
and the welfare of the nation . If they do ( something ) so, in their doing you
find goodness , if they make brothers, they do so for the sake of Almighty God
, and if they make enemies , also they make enemies for His sake alone .
And his
Eminence Ayatollah Al - Sheikh M. Ishaq Al - Fayadh is one of
those people who did migrat to honorable Najaf , drank from its pure sciences ,
have been brought up in its school , and have been characterized with its
principles and ethics , as a hardworking student and later on as a skilful
teacher , until he became one chief of its chiefs , and one of its prominent
big scholars , who lays on his shoulders the responsibility of one of the most
important studying rings in it , in addition to the mission of being the
authoritative source whom people follow and imitate in lawful rules .
His Journey Toward Iraq : -
Al - Sheikh
Al - Fayadh shifted , after a year of studying in the hawza of Mashhad
city, to the holy city of Qum willing to
visit the shrine of lady Ma`sooma , the sister of Imam Ridhah ( peace be upon
them both ) , then he shifted to Ahwaz city , then Muhammara , where he resided
in a hotel , and after a period of time he made contact with the solemn master
Abu - Al - Hassan Al - Bahrani ( God spare his soul ) , who was the religious
leader of Al - Muhammara city and was one of the well known religious
personalities there . Then he started to arrange his traveling affairs to
Basrah , and that solemn master ordered the guide to take the guest ( I . e. Al
- Sheikh Al - Fayadh ) to Basrah,to the house of Al - Sheikh Abdul
Mahdi Al - Mudhaffar ( God spare his soul ) , who was at that time , one of the
outstanding religious personalities in Basrah ,
whose house was a shelter to people , where the big assembly and sizable
guestroom , where the light Islamic generosity, ethics , and faithful service can be found .
From Basrah to Najaf : -
Al -
Sheikh Al - Fayadh stayed at Al - Sheikh Al - Mudhaffar`s for a
couple of days , until Al - Sheikh Al - Mudhaffar could arrange his
traveling - by means of Mr. Ali Al - Hakkak, the owner of the traveling
company, who was well known in Basrah - to honorable Najaf by means of the
train which took him to Al - Musayab city that lies 60 Kms to the south of Baghdad , then he
moved to holy Kerbala , and after he visited the two shrines of Imam Hussain
and his brother Al - Abbass ( peace be upon both ) , he travled on the same day
to honorable Najaf , then, and after he did the visit rituals of the shrine of
Imam Ali Ibin Abi Talib ( peace be upon him ), he settled, down as a guest, at Al
- Sheikh Ghulam Hussain`s , who is one of students of Al - Saleemia School
which is situated in Al - Mishraq quarter .
At Honorable Najaf : -
The new
student arrived at Najaf while he was at the early beginning of his eighteens ,
and on his way to it - as we mentioned - he passed through many experiments
that polished his gifts and taught him some lessons from the difficulties of
life , however various and different they were , also these experiments taught
him how living systems differ among themselves , the systems of morality and customs in several different cities , but
honorable Najaf as a city and the scientific hawza as a school , both
have their own difficulties , special circumstances , and troubles , the same
as different customs and traditions be among people and countries . On the
other hand , Najaf has its own positive characteristics which at the beginning
of them arises the blessed existence of the shrine of the Prince of the
faithful Imam Ali ( peace be upon him ) , also the openness and the scientific
advance of its religious hawza that qualified it to be on top of the
other hawzas , to take the leadership of them , to graduate thousands of
scholars , to let the high Marjeeia of the sect settle down in it , and
to let the thoughts and sights of the students ,of the lovers of Ahlul Bayet
sciences , and of their ( peace be upon them ) followers from all over the
world , be attracted to it.
And on the
new lodger lies the responsibility of accommodating himself with these
circumstances and bearing the sequent difficulties , depending on his
insistence and persistence of continuation , starting from bearing its very hot
climate in Summer , and the stinging cold of its winter , the necessity of learning Arabic at first for
those new comers who are not native speakers, the search of a suitable place
for residing , and the inspecting among hundreds of studying rings that were
spread at tens of schools and mosques at the outskirts of the city to find the
suitable ring to the pupil , taking into consideration the level of the consulting teacher , also the
way of gaining systemized text books or those books the student needs for his
own reading in the different fields of knowledge , then to the responsibility of
making acquaintance with other students and their scientific and ethical levels
in order to choose some of them as classmates and friends in studying and
research , also the necessity of guarantying adequate sources of food , clothes
, the living necessities , and other
things . The Sheikh M . Ishaq Al - Fayadh , in this concern , says : ((
My coming to honorable Najaf , after several years from the death of Mr. Abul
Hassan Al - Assfahani ( I . e. The previous Marjee and Grand Ayatollah
at his time ) , at the last days of the Royal Reign Period , and at the
beginning of Mr. Muhsin Al – Hakeem`s Marjeeia period who had been
making monthly salary to the students about two dinars for each married student
, and one dinar for the single student like me ( at that time ) , and we mostly
ate bread and onion ( at that time ) , and it wouldn’t come to the mind of
anyone of us , at any time , to eat something called fruits )) .
Visiting Scholars & Schools : -
Since the new
student and the lodging guest settled down at one of the students` rooms , whose
lodger was one of his people who preceded him in coming to Najaf , sharing him
his little room at Al - Saleemia school , since that he started to visit
scholars and Marjees to do his duty towards them, in showing his
respects, making close acquaintance with them , and asking their advise and
guidance in respect of the mission that he dedicated himself to , which is
learning and serving religion , as well as ,serving faithful people . He also
visited several schools and mosques which were crowded with teachers and groups
of students in studying rings , and he searched here and there looking for a
suitable teacher and an appropriate studying ring . The one who was helping him
in these things was His Eminence, the departed savant , Al - Sheikh M.
Ali Al Afghani , who is known with (Al -Mudarriss) ( I . e . the teacher
) , who was too much interested in and pursuing the facilitating and achieving
of the students` requirements ,as well as , the fulfillment of the students of
his people's needs , those students who were residing in honorable Najaf and
specially the new comers of them .
That Sheikh
who was called Al - Mudarriss ( I . e. the Teacher ) , since that he was
the well known skillful teacher of ( the stage of ) Al - Muqaddimatt ( I
. e . the beginnings of Al - Hawza studying ) and of ( the stage of ) Al
- Sutooh ( I . e . the stage that follows that of Al - Muqaddimatt
and precedes that of Bahth Al - Kharij ) . That Sheikh took Al
- Sheikh Al - Fayadh with him to visit the departed Ayatollah Mr. Al
- Hakeem at his public assembly , and then to visit Mr. Al - Khuee at his house
, because of the special relationship that linked Al - Sheikh Al - Mudarriss
with him and because he was close to him .
Settling at School : -
Al - Sheikh
M. Ishaq remained sharing his host Al - Sheikh Ghulam Hussain in his
little room at Al - Saleemia school for several months , until his comrade
decided to( complete the other half of his religion by marriage) , and God let
him succeed in doing so , therefore , he left residing at school and shifted to
the new residence , so , Sheikh M. Ishaq remained at that room alone
devoted to studying , searching , reading , and writing .
Lessons and Teachers : -
From the
first time Al - Sheikh Al - Fayadh arrived at Najaf and settled
down at school , he started , in longing , seriousness , and hard working ,
with no tiredness or boredom , to complete what is left unfinished of the books
he read at the village school or at Mashhad hawza , therefore , he read
the book (Qawaneen Al Usool ) for Abul Qassim Al - Qummi , which is well
known in hawza as the book ( Al - Qawaneen ) , the book ( Hashiat Mulla Abdullah ) and part of
the book ( Al - Rawdha Al - Bahia fi Sharh Al - Lumaa Al - Dimashqia
) at the teacher , the departed , Al - Sheikh Mirza Kadhum Al -
Tabreezee , and finished the book ( Al – Lum'aa ) at the teachers the
departed Mr. Asad Allah Al - Madani and Al - Sheikh Mirza Ali Al -
Falsafi ( God lengthen his patronage ) , he also , finishes studying the book (
Al - Mutawal ) at the departed Sheikh M. Ali Al - Mudarriss
.
Then the hard working student shifted to the studying
of the stage of ( Sutooh ) in order to be qualified to attend Al -
Kharij Researches at the big scholars , therefore , he read at this stage (
I . e. Al - Sutooh ) the book ( Al - Kifaya ) of Al -
Sheikh Al - Akhond Al - Khurasani , and the two books ( Al - Rasaeel
) & ( Al - Makasib Al - Muharrama ) of Al - Sheikh
Murtaza Al - Ansari at the departed Al - Sheikh Mujtaba Al - Lankurani ,
also at that period he was discussing those books , which he was studying with
some of his colleagues , and was teaching , what he had finished studying , to
the students who were still beginners , as that was current in the teaching
system of hawza at honorable Najaf , that the student starts training ,
from the beginning , to learn the teaching system while he is studying at
higher stages , therefore , he is student and teacher at the same time , and
this stage is called , at the convention of hawzas , the stage of (Sutooh)
, which takes about five years to be finished , if the student is hardworking
and persistant . Al – Sheikh Al – Fayadh finished it in less than that ,
then he , quickly , joined the biggest of scholars' (Kharij) researches
.
(Al – Kharij) Research : -
After Al
- Sheikh Al - Fayadh stood on the vast horizon of Islamic ideology and had
been accustomed to the spiritual and scientific atmospheres of the studying
stage of Sutooh , at which he studied the common text books at the best
scholars and prominent teachers, as mentioned before , the stage that he
finished in distinguished success and
praise of his teachers , he turned to the studying stage which is well known as
Bahth ( I . e . Research ) Al - Kharij where lies the
responsibility of preparing and making ready on the shoulders of the student
himself , without being restricted with one specific scientific source or one
specific book , so that the student himself dose , before attending the lecture
prepare the material of the lecture , whether Fiqih or Usool ,
then he reviews the scholars' statements on this material , and what might be
suitable proof for it , also what might be suitable in discussing that proof ,
then student attempts to conclude to himself a private opinion , concerning
that problem . When he is finished with that , he attends the research of the
teacher to listen to his instructions , to look for the problem's origins and
what might be related to it . Afterwards ,he starts to discard the opinions of
the biggest scholars concerning that problem with what might be suitable proof
of it and what might be appropriate to be discussed in it . At last , he
discards the opinion of the teacher himself , as the teachers of Al – Najaf
school are used to combine between the solemnity of old age the justice of
Right , together with the following of that right wherever it might be , without
paying attention to the scientific position of that student or his age , if he
proved to be right . Therefore , it is clear that Al – Kharij lesson in honorable Najaf has got a special
kind of supervision and general
directing , both scientifically and morally , in addition to that , the
polishing of talents , which is done by
experienced teachers , who have been practicing teaching , searching , and
putting theories for a lot of time , and they where known with their rightful
ideology , their deep view and precision of turning , also with the vastness of
their knowledge . The studying rings of Kharij might get wider and wider
in number , depending on scientific fame of the teacher , on extent of his
successful clarification and the way of showing the material , on his strength
in bringing about evidences while discussing opinions , and on what new
production he introduces in that field .
And the
student continues on that way of studying in Fiqih and Usool
until he reaches the stage of Ijtihad while he , at the same time , is
running special studying rings in Al - Sutooh stage , as mentioned before
, and when the student reaches Al – Ijtihad ( I . e . exerting efforts
in searching , concluding , forming evidences , collecting of hadeeths (
I . e . tales ) with the scholars' points of view , and then the discussion
upon the sayings) . After this long
stage , which may take more than a quarter of a century , the student will be
independent in Ijtihad , in showing his own point of view , and in
giving instructions .
It is said
about the term ( Bahth Al - Kharij ) that this stage is called so ,
since that teaching in it is done out of the books' texts , and it dose not
depend on a private point of view or a certain clause of a certain book as is
the case with the preceding stages , so that the student trains , during that
stage of higher studies , the ( Ijtihad ) ( I . e . how should he bring
about his legal point of view , concerning the legislation rules ), so he will
not get graduated from that stage , until he finds himself confident in his
vastness of knowledge & preciseness
of views with their investigations .
The general
impression of the rings of Al - Kharij Research could be seen in the
perfect freedom in giving the one's point of view and expression , which results
from the Ijtihad freedom that interferes in the constructing of the
scientific personality of Al - Najaf school , therefore , it is the right of any
student to interrupt the lecturer and
discuss some of his views , and the lecturer , whatever his scientific fame
might be , will never find it embarrassing to adopt the view of the student if
he finds that it is the right one . Al - Kharij Research could be
attended , in many times , by big Mujtahids ( I . e. those who got high
degrees of Ijtihad ) , as the research of Al – Saiid Al – Khuee
was , when he became a teacher of that lesson ( I . e . Al – Kharij
Research ) , and so in such atmosphere that is full of research , investigation
, and penetrating deeply into sciences , the Najaf student grows up , and the
Islamic ideology questions , Fiqih , and Usool be developed and
clear to him .
Al - Sheikh
Al - Fayadh attended Al - Kharij Research at the beginning of the
twenties of his age , and he had chosen
to attend the rings of some big teachers
of Al - Najaf scholars ( who were excellent in their lessons) for several
months , until he settled down on the research of his teacher who was well
known by his students , and his students were well known by him , since every time
Al - Khuee is mentioned , it is mentioned with him Al - Rawhani , Al - Saddir ,
Al - Seestani , Al - Fayadh , and others of his best students , and if one of
them is mentioned it is connected with him the mentioning of Al - Khuee as his
teacher .
Al - Sheikh
Al - Fayadh continued to attend that lesson every day for more than fifteen
years without interruption , in both rings of Fiqih and Usool , persistent
, continuing , and as a research writer .
The Writing of
Statements : -
The good scholars of
scientific hawza have got used to repeat the researches of their teacher
, after lesson , on some of their colleagues , and write them down after
investigation , taking out sources , and the comparison between the views and
their evidences , afterwards , they show that work to the teacher , if he
agrees about the statements , they will be printed and published , in order to
be an evidence on the powerfulness of research and to show the teacher's views
and the student favors . Those books are well known among the scientific hawza
environments as ( Al - Taqrirat ( I . e . the statements ) ) .
Al - Sheikh Al - Fayadh
since his attendance of his teacher's research ( the research of Al - Khuee )
he was accustomed to do so (I . e . writing statements ) , therefore , he was
repeating the research on some of his colleagues , and then write it down ,
persistently , day after day , in both rings of Fiqih and Usool ,
until he finished writing the fifth round of his teacher's research in Usool
Al - Fiqih Science , and his work became the book known as ( Al - Muhadharatt ) .
The Beginning of Fame : -
It is known , in the system of
the religious hawza , that there is no stage that is restricted with a
limited period of time , or with a certain examination , which if the student
passes he be granted a graduation certificate , by which he be well known later
. But fame , admission of favor by others and of the scientific level of the
student , come through his continuous attendance in hawza , studying ,
teaching , negotiating , and discussing in assemblies , when a certain question
is put forth , then on top of that and at the beginning lies the writing down
of the teacher's researches by the student with the teacher's agreement on the
printing of these statements joined by a
testimony on them , through what he writes when giving permission for
printing , ( that testimony ) is called in the convention of hawza : ( Taqreedh
Al - Ostath ) ( I . e . The teacher's comment on the statements ) . That
comment comes usually concise too much , but it be of big meaning and high
significance , and it may be of great connotation in testifying the student's
level and favor depending on the teacher's fame and scientific level . And from
that comes the student's fame , the
spread of his name and the acquaintance with his rank and scientific level in all of the hawza environments .
The comment of Al - Saiid
Al - Khuee on the statement of Al - Sheikh Al - Fayadh come in his
saying : (( What is written as a statement of my researches was in eloquent
style and Knowledge that is worthy of praising and admiration )) . And this is
the text of that comment , that exists within the introduction of the first
part of the book ( Al - Muhadharatt ) ( I . e . the lectures ) : -
In the Name of God , Most Gracious
Most Merciful
Praise be to Allah the
Cherisher and Sustainer of the worlds , and peace with God's greetings be upon
the most honorable Messenger : Muhammad with his good and chaste family , and
curse be upon their enemies all , till the Day of Judgment . Then :
I praise God highly for his
giving me the responsibility of bringing up some of those students who are
characterized with qualification and grace , until they , one after the other ,
reach the elevated degree of Knowledge and favor , and one of them whom I have
been successful to take care of , who attended my high researches of Fiqih
and Usool , who is the delight of my eye , the excellent scholar , and
virtuous investigator Al - Sheikh M . Ishaq Al - Fayadh ( God's
assistants to him be continued ) , and he showed me the first part of his book
( Al - Muhadharatt fi Usool Al - Fiqih ) which he wrote down as a
statement of my researches , in eloquent style and knowledge that is worth of
praising and admiration , so I give him my blessings for this prosperous effort
, and I ask God ( to be lofty ) to grant him success in achieving his aim ,because
He( to be lofty ) is the master of
success . ( in the sixth of Second Jamadi 1382 A.H. ) . Abul Qassim Al - Musawi
Al - Khuee .
By the observing of the
comment date , corresponding to ( the 4th of Nov . 1962 A.D. ) which
is the printing date of the book , and by observing the age of Al - Sheikh
Al - Fayadh when he was young , also what his teacher said in his concern at
that time , it would be clear what scientific rank and high favor our great Sheikh
had , and what big love and admiration did his teacher has towards him , since
that date .
It is narrated that when Al
– Sheikh Al – Fayadh introduced the statements of his teacher's researches
for the sake of getting permission on printing them , there where some of those
who disagreed , objecting against the consent of Al – Saiid Al – Khuee
on that , by weak pretexts which did not
depend on healthy logic , such as the student's age and nationalistic
belongings . Al – Saiid Al – Khuee said in return that the
criterion is the student's knowledge , favor , and what can be an evidence (
that is taken from his statements ) on his exerted efforts , hard working ,
intelligence , persistent work , continuation , and strength of notes , but not
his age , because these objections and the like , which depended on my little
age , at that time , were attempts to
prevent my teacher Al – Sheikh Al – Naeeni ( God spare his soul ) from
giving me , myself , his permission on printing the statements of his
researches which I had written down , entitled ( Ajwad Al – Taqreeratt )
( I . e . The best statements ) , so that it is obligatory to be just
concerning others' rights and to give everyone what he deserves exactly . In
addition to that , we ought to encourage the hardworking and persistent student
, and support him continuously . And everything did happen as he said ; the
teacher gave his permission on printing the statements , with a suitable praise
on their writer , and Al – Saiid Al – Khuee did the same with all his ( Mujtahid
) students . His Eminence Al – Sheikh Al – Fayadh says at the beginning
of these statements : -
In the Name of God , Most Gracious
Most Merciful
Praise be to Allah the Cherisher
and Sustainer of the worlds , and peace with Gods greetings be upon the best of
his creatures Muhammad and his chaste family , and continuous curse be upon
their enemies all . This is the first part of our book ( Muhadaratt fi Usool
Al - Fiqih ) and it includes what I had benefited from , as high
investigations , lofty subjects , and newly invented ideas , from the assembly
of my teacher , the magnificent , His Eminence grand Ayatollah Al -
Saiid Abul Qassim Al - Khuee , that I dedicated myself among the hundreds
of students on attending the assembly of his honorable lesson at the biggest
scientific university ( I . e . honorable Najaf ) which he had been given the
leadership of , and had been under his conduct ( at that time ) .He , towards
which , did his duty with all his best , through his lectures , researches ,
the generation of righteous scholars whom he brought up at his generous hands .
And I while I invoke the Master
( I . e . Allah ) ( to whom be ascribed all perfection and majesty ) to grant
me success , in order to join the second part with this part in printing , I
ask Him ( be He exalted ) to let us and all Muslims enjoy the continuity of
existence of our most magnificent teacher and let his flourishing days of
benefit continue .
And all my success is from God
, on Him I depend and to Him I turn in repentance .
M. Ishaq Al - Fayadh
God has granted His Eminence success to finish printing the five parts of
statements in Usool Al - Fiqih science . This work is considered ,
nowadays , one of the most important scientific sources in that art , scholars
and students of religious sciences use it frequently in all hawzas
through studying , teaching , reading ,
and reviewing in order to know the new points of view , ideas , and theories that
these ( statements )do include , which they cannot spare .
Teaching : -
During that period and later
on , our Sheikh Al - Fayadh was one of the prominent teachers who were
well known in hawza , since he gives his lessons and researches to a big
congregation of virtuous students of religion sciences , teaching the familiar
books of ( Al – Rasaeel , Al – Kifaya , and Al - Makasib) to the level of high Sutooh, in several
rings at Al - Hindee mosque which is well known at Najaf , also he was the
teacher of that stage for more than ten years at ( Religious Najaf University )
which is founded by the departed Mr. M. Kalanter , until he started to give Al
- Kharij researches in ( 1978 A.D.) at the school of Mr. Al – Yazdee
( the small one ) which lies at Al - Umara quarter , and when the well known school
( Dar Al - Elem ) , which is founded by Al - Saiid Al - Khuee (
in 1980 A.D. ) , is opened , his research assembly shifted to that place until
the date of it's destruction , so the teaching assembly shifted to the big
Hindee mosque in short period , then , to Al - Yazdee school which is founded
by the grand Marjee Mr. Kadhum Al - Yazdee till present day . That
research assembly is attended by a big congregation of students , many of them
are virtuous , who are writing down his researches hopping to print them , by
the will of God ( be He exalted ) .
The committee of Consultation : -
Because of what has been
familiar to the great Marjees , in constructing a committee out of their
private and close virtuous students , with some prominent scholars , that
committee is called ( The committee of consultation ) , which is constructed
for the sake of answering the big ( flood ) of letters and question that arrive
from different parts of the world . Answering usually comes after examining ,
searching , discussing , and investigating , until they reach the right
legitimate point of view , then after they get the consent of Al - Marjee
they write it down as an answer to the arrived question . That process may take
several days before getting consent on it . And because of the long period of
time , that surpassed a quarter of a century , the Marjee position of Al
- Saiid Al – Khuee took , because of the agreement of the hawza
teachers together with that of his great students , who one of them was the
well known scholar and genius researcher Mr. M. Bakir Al - Sadir ( his soul be
sanctified ) , on his superiority in knowledge , and because of his numerous
followers in different spots of the world , therefore , the consults that reached
to him , every day , from the Islamic world countries , in different languages
, were many , therefore , the departed leader was motivated to construct a
committee of consultation from scholars , and big mujtahids of his
students to fulfill that mission , and His Eminence ( Al - Sheikh Al -
Fayadh ) , because of what he possessed of high qualifications of virtue ,
knowledge and closeness of position to the leader Al – Khuee , he was one of
those who were responsible for that work , continuously working for more than
twenty five years , till the last day of the departed leader's life ( his soul
be sanctified ) , and as it was familiar , that committee included , in
different periods of time , the names of big scholars and great mujtahids
who occupied the position of Marjee later , or who was , actually ,
holding that position , such as , grand Ayatollah Mr. : Ali Al -
Bahashti ( may his patronage last long ) , Ayatollah Mr. : Murtadh Al -
KhulKhali ( God relieve him ) , Ayatollah Mr. Al - Rawhani , Ayatollah
Al - Sheikh Mirza : Ali Al - Gharawi ( his soul be sanctified ) ,
Ayatollah Mr. M. Bakir Al - Sadir ( his soul be sanctified ) , Ayatollah
Al - Sheikh Mirza Jawad Al - Tabreezee , Ayatollah Al - Sheikh
: Waheed Al - Khurasani , Ayatollah Mr. : Takee Al - Qummi , Ayatollah
Al - Sheikh Mirza : Ali Al - Falsafee , Ayatollah Mr. Ali Al -
Seestani ( may their luxuriant patronage last long ) , and many other virtuous
scholars and big teachers of scientific hawzas . 02/05/2007
The Writings :
Despite the
many engagements of our great Sheikh in doing his religious duty of
serving faithful people , through his lessons , his bringing up of virtuous
students continually , and his daily
attendance at the consulting assembly of the leader Al - Khuee at the days of
his life ( his soul be sanctified ) , and other social engagements in executing
the people's needs , and since they turn to him to get the legitimate rules and
to fulfill their private needs and other things , despite all these engagements
and responsibilities , His Eminence dedicated some of his time for
investigating and writing to enrich the Islamic library with his valuable
writings . And what is printed of them till now is :

Muhadharatt fi Usool Al - Fiqih , in ten volumes , five of them ,
just , are printed .

Al - Aradhee .
3.
Al - Nadhrah Al - Khatifa fi Al - Ijtihad .
4.
Taaaleeq Mabsootah ala Al - Urwatlwithqa , ten parts are printed .
5.
Ahkamm Al - Bunook .
6.
Minhaj Al - Saliheen , in three volumes .
7.
Manasik Al - Hajj .
8.
Al - Mabahith Al - Usoolia , in fourteen volumes , three
volumes are printed , and all other volumes follow .
God let the days of His
Eminence last in goodness , in increasing success and giving , to serve the
true religion and right purifying way , may God make him reservoir of this
nation , through letting his honorable shade last long over the heads of people
, And praise be to Allah the Cherisher and Sustainer of the worlds .
